The Liberia-flagged MV MSC MANASA F, along with its hull, tackle, engine, machinery spares, gear, clothing, paraphernalia, furnishings, etc., is currently anchored at Vizhinjam Port and has been ordered to be arrested by the Kerala High Court. Until the corporation deposits a total of Rs 6 crore with the High Court, the injunction will stay in force.
Five exporters lost their consignment after the shipwreck, and Justice MA Abdul Hakhim gave the order in their admiralty complaint. The petitioners’ attorney, advocate Joy Thattil Ittoop, said that each of them had misplaced several containers.
Since the shipping business does not own any real estate or moveable assets in India, they are allowed to use the court’s admiralty authority to have the vessel arrested and detained. They argued that they would suffer irreversible harm and loss if proper precautions were not taken until the security was provided.
The court stated unequivocally that if the money is deposited or the corporation provides security to the court, the warrant of arrest would be withdrawn and the conditional order of detention will be instantly annulled without any further orders.
